Welcome to Supabix, accessible at supabix.com or www.supabix.com. Supabix refers to the owner(s) and operator(s) of this web app, as well as the web app itself and the Services provided through the website.

“Services” means Supabix’s web application, related features, and any other services provided through supabix.com.

These Terms and Conditions ("Terms") govern your access to and use of our Services. By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please refrain from using our Services.

1. Overview of Services
Supabix provides the following Services:

  • Monthly Subscription Plans: Subscribe to create and download AI-generated images, thumbnails, and videos according to the monthly credits allocated to your chosen plan and any additional credits that you may purchase.
  • Monthly Credits: Each subscription comes with a set number of monthly credits.
  • Extra Credits: If you exhaust your monthly credits before the month ends, you may purchase additional credits.
  • Plan Variations: Higher-tier plans may include advanced features and higher generation limits.
  • Auto-Renewal: All subscriptions are auto-renewing on a monthly basis.

2. Account Creation, Management, and Termination

  • Sign-Up: Certain features, including the ability to generate or download any AI-generated content require you to sign up for an account. Our Services are not intended for individuals under the age of 13. By signing up, you affirm that you are at least 13 years old.
  • Newsletter and Promotional Communications: By signing up for an account, you consent to receive newsletters, Services updates and promotional emails from us. You may opt‑out at any time by contacting support@supabix.com.
  • Account Termination by User: You may terminate your account at any time by contacting support@supabix.com. Upon termination, any remaining credits will be forfeited, and no refunds will be issued.
  • Account Termination by Supabix:
    • If you do not have an active monthly subscription for more than 1 month, your account can be terminated.
    • Supabix reserves the right to suspend or terminate your access to the Services at its sole discretion for violations of these Terms, or in the event of suspicious, unlawful activity, unacceptable usage, or misuse, as determined by Supabix.
    • Upon termination, any remaining credits in your account will be forfeited, and no refund will be provided.
    • Supabix reserves the right to grant, suspend, or terminate any user’s access to the Services at any time, for any reason or no reason, at its sole discretion, without prior notice or liability.
  • Business Closure: In the event that Supabix permanently ceases operations, we will make reasonable efforts to notify users in advance and provide a limited timeframe to export relevant data or use any remaining credits. After such period, access to the Services may cease entirely. Supabix shall not be liable for any resulting disruption or loss.
  • Change of Ownership: If Supabix is acquired, merged, or transferred to another party, your account information - including credits and stored content - may be transferred to the new owner. Continued use of the Services will be subject to the acquiring party's terms and policies.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials. Supabix is not liable for unauthorized access to your account.
  • Content Deletion: If a user does not maintain an active subscription for more than one (1) month, we reserve the right to delete all generated content and related files associated with that account. Such deletion is final, and the user will need to restart afresh upon resubscribing.

Note: Data retention policies under Section 9 apply following account termination.

3. Purchases and Subscriptions

  • Credit Purchases: Credits are required to generate images, thumbnails, and videos. Credit purchases are final and non-refundable unless otherwise specified.
  • Subscriptions: Subscriptions are billed monthly and include a fixed number of credits.
  • Proration of Upgrades and Downgrades:
    All subscription payments are handled by Polar. For Polar, both upgrades and downgrades take effect immediately, and pricing proration is calculated directly by Polar. Supabix only handles in-app credits allocations. For ease of implementation and fairness, credit adjustments are subject to rounding to the nearest whole number, and a margin of ±1 day may be factored into the calculation. This means you may gain or lose up to one (1) credit in the process of proration.
  • Price Changes: Supabix reserves the right to modify prices for credits, subscriptions, and other Services. Changes will be communicated on our website and will apply to future purchases or renewals.
  • Pro Trial: We currently offer a one-time Pro Trial that provides a fixed number of credits. The Pro Trial is available only once per account and requires sign-in with a valid Google account. Trial credits cannot be transferred, refunded, or replenished, and expire once consumed. Abuse of the trial offer (such as creating multiple accounts) may result in account suspension or termination.

4. Refund Policy

Your purchases, including credits and subscription fees, are governed by our Refund Policy. By using our Services, you agree to the terms outlined in the Refund Policy.

5. Ownership of Generated Content

  • You own the rights to the content you generate, subject to these Terms and applicable laws.
  • Supabix retains a non-exclusive license to use your generated content for promotional, research, or platform-improvement purposes unless you are subscribed to the premium plan.
  • You are solely responsible for ensuring your use of generated content complies with all intellectual property laws. Supabix is not liable for any third-party claims regarding content ownership or infringement.

6. AI Limitations

  • AI-generated outputs may contain inaccuracies, biases, or unintended results.
  • You are responsible for reviewing outputs before commercial use.
  • Supabix does not guarantee that outputs are fit for any specific purpose and disclaims all warranties relating to accuracy or reliability.

7. User Responsibilities and Acceptable Use

  • You agree to use our Services in compliance with all applicable laws and regulations.
  • You may not use Supabix to generate or distribute content that is harmful, illegal, misleading, or malicious.
  • You may not use Supabix to generate deepfakes or impersonations of real people without consent. You are solely responsible for ensuring that you have obtained the rights and permissions before uploading or using any face or likeness in Supabix.
  • You may not use Supabix to generate content that infringes upon a third party’s privacy or likeness rights.
  • You may not use Supabix for political manipulation, harassment, spam campaigns, or to infringe upon any third-party intellectual property rights.
  • You are prohibited from attempting to disrupt or interfere with the proper functioning of our Services.
  • You may not use Supabix to generate content that depict or direct users to anything that Supabix, in its sole discretion, determines to be obscene, mature content, illicit, immoral, promotional content for age-restricted products or services, or otherwise unacceptable. Supabix reserves the right, in its sole discretion, to suspend or terminate, without notice or refund, any account engaging in such activity.

8. Services Availability

  • We strive to maintain continuous Services availability.
  • Services interruptions may occur for maintenance or updates.
  • Performance may be affected by rendering queues, rate limits, or peak usage
  • We are not liable for any temporary Services unavailability.

9. Third-Party services and links

  • The generated content may incorporate third-party elements, tools, or APIs. Supabix is not responsible for the content, policies, or practices of any third-party sites or services.
  • You acknowledge that accessing third-party content or services through our platform is at your own risk.

10. Data Retention and Deletion Policy

  • User data may be retained for a period of 1 month following account termination, after which it can permanently be deleted.
  • Users may request data deletion at any time by contacting support@supabix.com.

11. Force Majeure
Supabix shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, internet outages, acts of government, or technical failures.

12. Indemnification
You agree to indemnify, defend, and hold harmless Supabix, its affiliates, and its employees from any claims, damages, or legal actions arising from your misuse of the Services or violation of these Terms.

13. Limitation of Liability

(a) Disclaimers.

To the maximum extent permitted by applicable law, Supabix shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of, or inability to use, the Services, including but not limited to loss of credits, data, profits, business interruption, or corrupted/generated content. Supabix takes no responsibility for any failures or inaccuracies in AI outputs.

(b) Liability Cap.

Notwithstanding anything to the contrary in this Agreement, Supabix’s aggregate liability for all claims arising under or relating to this Agreement shall not exceed the total fees actually paid by you to Supabix during the three (3) months immediately preceding the event giving rise to the claim.

14. Privacy Policy
Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your data as outlined therein.

15. Intellectual Property
All content, including designs, trademarks, logos, and text on supabix.com or www.supabix.com, is the intellectual property of Supabix and may not be used without prior written permission.

Third-party logos or images used on this website for preview purposes are the property, and where applicable the registered trademarks, of their respective owners.

Any feedback provided may be used or published without any compensation.

16. Changes to Terms
Supabix reserves the right to update or modify these Terms at any time. Changes will be effective immediately upon being posted on our website. Your continued use of the Services after such changes are posted will constitute your acceptance of the revised Terms. It is your responsibility to review the Terms periodically for updates.

17. Governing Law and Dispute Resolution

(a) Governing Law.

This Agreement shall be governed by the laws of the jurisdiction selected by Supabix in its sole discretion, which may include the jurisdiction in which Supabix is registered or has its principal place of business.

(b) Arbitration.

Any dispute, controversy or claim arising out of or relating to this Agreement (a “Dispute”) shall be finally resolved by binding arbitration under procedural rules selected by Supabix in its sole discretion. Supabix shall also, in its sole discretion, determine the seat, venue, and language of the arbitration.

(c) Enforcement.

The arbitrator’s award shall be final and binding on the parties and may be entered and enforced as a judgment in any court of competent jurisdiction selected by Supabix in its sole discretion.

(d) Interim Relief.

Notwithstanding the foregoing, Supabix may choose any court (including the courts of the jurisdiction in which it is registered or has its principal place of business) of competent jurisdiction to seek provisional or injunctive relief at any time, before, during, or after arbitration, to protect its rights under this Agreement.

18. Export Control and Compliance

  • You agree to comply with all applicable export laws and regulations.
  • You may not use or distribute Supabix Services in violation of any international export laws.
